When you use the website, you are responsible for maintaining the confidentiality of your account and password. Please ensure that the details you provide are accurate and complete. Notify us immediately of any changes to your registration information.

Animi Causa reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

Privacy

Please review our Privacy Policy, which explains how we will use the personal information that we collect about you, including any photos, videos, or other content you upload to personalize a product.

Copyright & Trademarks

All content included on this website, such as photographs, text, graphics, logos, button icons, images and software, is the property of Animi Causa, its affiliates or its content suppliers and is protected by intellectual property laws Internationally.

Animi Causa and its exclusive brands, logos and imageries indicated on our website are trademarks or registered trademarks of Animi Causa and may not be used in connection with any product or service that is not Animi Causa, in any manner that is likely to cause confusion among customers, disparages or discredits Animi Causa.

Your Uploaded Content

Some of our products, including personalized greeting cards, let you upload your own photos, videos, text, and links to personalize your order (“Your Content”). By uploading Your Content, you confirm that:

• you own Your Content, or you have the necessary rights and permission to upload and use it;
• if Your Content shows another identifiable person, you have that person’s permission to use their image or likeness this way – and if that person is a minor, you have the permission of their parent or legal guardian;
• Your Content does not infringe anyone’s copyright, trademark, privacy, publicity, or other legal rights; and
• uploading and sharing Your Content does not violate any law.

You grant Animi Causa a limited, non-exclusive license to host, store, reproduce, and display Your Content solely to create, process, fulfil, and deliver your order and the shareable card, and to provide customer support related to it. We do not use Your Content for marketing, advertising, or any other purpose beyond fulfilling your order, unless you separately agree to that use.

You may not upload content that is, or that you do not have the right to share as: sexually explicit or pornographic; hateful, discriminatory, or harassing; violent, graphic, or gratuitously disturbing; defamatory or knowingly false about a person; infringing of copyright, trademark, or other intellectual property; someone else’s private information shared without their consent; malware, tracking code, or malicious links; or otherwise illegal under applicable law.

We do not review every upload before it is used to produce a card. We reserve the right, but do not accept an obligation, to review, refuse, or remove any uploaded content at any time, including after a card has been shared, if we believe in good faith that it violates this policy or the law. We may refuse to produce, may remove, or may cancel an order containing content that violates this policy, and for content that is illegal, infringing, or exploitative of a minor, we may refuse a refund for personalization work already completed and may report the content as required by law.

If you believe a card created through our service uses your image, likeness, or copyrighted work without permission, please contact us with the card link and a description of your concern, and we will investigate and remove content found to violate this policy.

You agree to indemnify and hold Animi Causa harmless from any claim or loss, including reasonable legal fees, arising from Your Content or from your breach of this section.

Our Contract

When you place an order to purchase a product from Animi Causa, we will send you an email confirming receipt of your order and containing the details of your order including cost of delivery. You can find out more about delivery costs here.

Your order represents an offer to us to purchase a product which is accepted by us when we despatch that product to you and is confirmed by an email we send to you confirming that we have despatched the goods (the ‘Despatch Confirmation Email’). Any products on the same order which we have not confirmed in a Despatch Confirmation Email do not form part of that contract.

You can review the orders you have placed and their current status, including tracking numbers, at any time by clicking ‘My Account’ from the homepage at www.animicausa.com . You are seeking to enter into a contract with Animi Causa, when you place an order.

If you place an order with us through a third-party marketplace platform, that order is also subject to the marketplace's own terms and conditions, in addition to these Terms and Conditions.

Returns & Replacements

Your satisfaction with our products is very important to us. We make every effort to select and sell the best products. If for any reason you are not happy with your purchase – just return it in new condition for a refund within 30 days.

All items in your order are inspected and deemed to be in gift giving condition by our store before your order is shipped.

If an item arrives damaged, notify us immediately so that we may work with you to arrange a replacement.(please send images of the box+product)

In case the order is shipped via express service a formal complaint to the carrier must be made within 24 hours of delivery. Otherwise we will not be able to deal with your issue.

Products that are made-to-order goods, including personalized greeting cards, cannot be returned. This does not affect our right to cancel an order without refund of personalization work if it violates the Your Uploaded Content section above. Some physical products are produced on our behalf by a third-party manufacturing partner; the made-to-order return policy applies the same way regardless of who manufactures the item.

Orders may be cancelled if work on the product has not yet begun.

Customers will be notified with an order confirmation after their order is received and given an opportunity not to proceed with the order.

Other orders can be returned back to Animi Causa if the return is in a saleable condition.

There are NO refunds allowed on the original shipping cost unless it was OUR error or the wrong amount charged.

Upon receiving a return, we will inspect the items and then issue a credit card credit.

Alteration of Service or Amendments of The Conditions

We reserve the right to make changes to our website, policies, and these Terms and Conditions at any time. You will be subject to the Terms and Conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable it will not affect the validity and enforceability of any remaining conditions.

Customs

When ordering goods from Animi Causa for delivery abroad the recipient may be subject to import duties and taxes, which are payable once the package reaches the specified destination. Any additional charges must be borne by the recipient and Animi Causa cannot advise on any customs taxes.

We would like our international customers to note that we are obliged to declare the full value of goods on all packages and all cross-border deliveries are subject to opening and inspection by customs authorities.

If delivery can't be completed due to unpaid import duties, when the parcel comes back to us a $20 fee may be deducted from your refund to cover the return charges and fees that we're billed by the carrier.

Jurisdiction and Choice of Law

Customers accept that dealing with Animi Causa they agree to these Terms and Conditions and that any contract formed with Animi Causa will be a contract under and subject to the laws of Israel whose courts will have exclusive jurisdiction in the determination of any disputes.

Electronic Communications

When you visit animicausa.com or send emails to us, you are communicating with us electronically. We communicate with you by email or by posting notices on the website.

For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that those communications be in writing. This condition does not affect your statutory rights.

Children

Animi Causa does not sell products for purchase to persons under the age of 18. If a product allows you to upload photos, videos, or other content, only a person 18 or older may upload that content, regardless of who the product or card is being made for.

Events Beyond Our Reasonable Control

We will not be held responsible for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any event which is beyond our reasonable control.

Disclaimer of Warranties

Our website and products are provided “as is” and “as available”. To the fullest extent permitted by law, Animi Causa makes no warranties, express or implied, regarding the website or its uninterrupted availability, beyond any warranties that cannot be excluded under applicable consumer protection law.

Limitation of Liability

To the fullest extent permitted by law, Animi Causa’s total liability to you for any claim arising from your order or use of the website is limited to the amount you paid for the relevant order, and we are not liable for any indirect, incidental, or consequential loss. Nothing in these Terms and Conditions limits any liability that cannot be limited under applicable law, or affects your statutory rights as a consumer.

Pricing and Availability

The availability information for products sold are included on each product information page. Please note that we cannot guarantee despatch dates and all despatch dates given are estimates. In the event that the product you ordered is unavailable we will let you know by email.

We describe every item on our website as accurately as we can. However, occasionally product descriptions or pricing errors occur. If after you have submitted your order we discover such an error or the item ordered becomes unavailable, we will do our best to inform you at the earliest opportunity. You may then choose whether to proceed with your order or cancel it. If we cannot contact you, we may treat your order as cancelled.
